Terms of Service for verselab.ai

1. General Provisions

1.1. By using verselab (the "Service"), available as a web app at https://verselab.ai and as a mobile app, you accept these Terms and confirm that you have read our Privacy Policy. 1.2. The Service is provided by: Jon-Tec Labs Jonatan Łoś, ul. Kaliskiego 15a, 01-476 Warszawa, Poland, NIP: 9512374671 (the "Provider"). 1.3. Contact: support@verselab.ai.

2. Service Usage

2.1. The Service is available to users over 16 years of age. Users under 16 may use the Service only with the consent of a parent or legal guardian. 2.2. Registration requires a valid email address or Google/Apple account.

3. License

3.1. License to use AI features is granted while the account is active. 3.2. We reserve the right to temporarily suspend access to AI features in cases of:

  • Terms of Service violations
  • System maintenance
  • Detected abuse

4. Intellectual Property

4.1. Users retain full copyright to created content. 4.2. By sharing content in the Service, you grant verselab.ai a non-exclusive license to process it solely for the purpose of providing the Service (e.g., generating AI suggestions, storing projects).

5. User Responsibilities

5.1. Prohibited Service uses include:

  • Creating illegal content
  • DDoS attack automation
  • Spam generation
  • Third-party rights infringement

5.2. You agree to:

  • Verify AI-generated content
  • Possess necessary rights for processed materials
  • Follow creative ethics guidelines

6. Liability

6.1. We are not responsible for:

  • Content generated by built-in AI tools
  • Consequences of using AI suggestions

6.2. We reserve the right to moderate content violating laws or Terms.

6.3. The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Provider does not guarantee that the Service will be free from defects, errors, or interruptions.

6.4. The User is solely responsible for verifying that any content created, generated, or edited using the Service does not infringe upon the intellectual property rights, copyrights, or any other rights of third parties before publishing, distributing, or otherwise making such content available.

7. Subscription and Payments

7.1. The Service is available in verselab pro monthly and verselab pro yearly plans (collectively, the "Subscription"). The Service may also offer a trial period or promotions; if available, their terms are shown at checkout.

7.2. Subscriptions may be purchased: (a) in the mobile app as an In-App Purchase in Apple App Store (iOS) or Google Play (Android), or (b) in the web app through the website checkout flow.

7.3. The Merchant of Record and payment processing depend on the purchase channel: (a) for purchases in Apple App Store / Google Play, the seller and billing entity is Apple / Google respectively, and payment is processed under those platform terms, (b) for purchases in the web app, the Merchant of Record is Polar.sh (Polar Software Inc.) for new subscriptions; users who purchased before Polar.sh implementation may continue with Stripe-processed subscriptions.

7.4. Subscriptions auto-renew monthly or every 12 months (depending on the selected plan), unless canceled before the end of the current billing period.

7.5. Cancellation and subscription management: (a) subscriptions purchased in Apple App Store / Google Play are managed in Apple ID / Google Play subscription settings, (b) subscriptions purchased in the web app are managed through the user's web account.

7.6. Refunds and payment complaints: (a) for purchases in Apple App Store / Google Play, refund and complaint rules follow Apple / Google policies and are handled by those platforms, (b) for web purchases, payment-related refunds and complaints should be directed to Polar.sh (new subscriptions) or to the Provider (Stripe-processed subscriptions).

7.7. Restore Purchases applies to In-App Purchases and is used to re-detect an active Subscription for the account.

7.8. Subscription access is tied to the verselab account. To use access across devices and platforms, the user should sign in with the same account.

8. Account Deletion and Data

8.1. Users may delete their account at any time by contacting the Provider at support@verselab.ai or using the appropriate option in account settings. 8.2. Account deletion results in permanent removal of user data within 30 days of the request, except for data required to be retained by law (e.g., billing data — up to 5 years). 8.3. Canceling a subscription is not the same as deleting an account.

9. Complaints

9.1. Complaints regarding the Service may be submitted to: support@verselab.ai. 9.2. A complaint should include: the user's contact details, a description of the issue, and the expected resolution. 9.3. The Provider will process the complaint within 14 days of receipt and inform the user of the outcome via email.

10. Final Provisions

10.1. These Terms are governed by Polish law. Disputes with consumers shall be resolved by the court having jurisdiction over the consumer's place of residence. In all other cases, the courts in Warsaw shall have jurisdiction. 10.2. Consumers have the right to use out-of-court complaint and redress mechanisms, including via the ODR platform: https://ec.europa.eu/consumers/odr/. 10.3. These Terms may be updated. Users will be notified of changes via email with 30 days' notice. If a user does not accept the changes, they have the right to terminate the agreement before the changes take effect.
